Ceist:

351 Mr. Creed asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Cork will receive an outstanding REP scheme payment for 2001. [2508/02]

A REPS compliance inspection was carried out by my Department on 28 June 2001 on the farm of the person named. A number of penalties were imposed due to breaches of the scheme conditions noted by the Department inspector, and since the penalties amounted to more than a year's payment no payment was made for the year 2001. The person named was notified of the penalties by letter dated 3 July 2001.

An appeal against the penalties was lodged on behalf of the person named on 26 September 2001 and it is under investigation by my Department. When that investigation is completed, a report will be submitted to the national REPS appeals committee which will review the case in its entirety. The appeals committee is independent and its decisions are final. Once it has reached a decision, the person named will be informed directly in writing of the outcome.
