Ceist:

43 Mrs. B. Moynihan-Cronin asked the Minister for Foreign Affairs the response the Minister of State at his Department received to representations she made to the Kenyan President regarding the shooting dead by police in 1997 of a person (details supplied); and if he will make a statement on the matter. [3748/02]

I refer the Deputy to the reply I gave to Question No. 157 on this matter on 21 November 2001.

The court hearing referred to in that reply, which was scheduled for 22 November 2001, did not take place. A further date for the hearing has not yet been fixed. The policeman, who is charged with the murder of the person referred to in the Deputy's question, is remanded in custody pending his trial.

At my request, the honorary consul in Nairobi remains in contact with the Kenyan authorities and has written to the Ministry of Foreign Affairs requesting that the case be dealt with as expeditiously as possible. He also maintains contact with the Franciscan Order, of which the person referred to in the Deputy's question was a member. The order has indicated that its legal representatives are monitoring the case also.

I hope that the legal process in this case can be brought to a conclusion as quickly as possible and I have asked the honorary consul to keep me informed of further developments.
