Tom Hayes

138 Mr. T. Hayes asked the Minister for Agriculture, Food and Rural Development the reason payment of area based compensatory allowance has not been made to a person (details supplied) in County Tipperary for 22.08 hectares mountain rights; the reason ten month and 22 month beef premium payments have not issued to this person; and if he will make a statement on the matter. [4850/02]

The person named applied for area aid in 2001 on a new plot of land, but further clarification relating to the maps which he supplied, was necessary. This clarification was obtained from the herd owner and details of the plot concerned are now being entered on the Department's electronic database. Payments under the 2001 area-based compensatory allowance scheme and the special beef premium scheme will issue as soon as possible.

139 Mr. T. Hayes asked the Minister for Agriculture, Food and Rural Development the reason for the delay in payment of a suckler cow premium and headage payment to a person (details supplied) in County Tipperary; and if he will make a statement on the matter. [4851/02]

The person named included a parcel on his 2001 area aid application on which an over-claim was determined. The applicant applied for a total of 23.71 hectares. The area determined was 22.01 hectares. This represents a difference of 1.7 hectares or 7.7 %. Under EU Regulation (EC) No. 2419/2001, the penalty is double the difference when the difference between the area claimed and the area found is between 3% and 20%. Therefore in this case a penalty of 3.4 hectares has to apply leaving the area determined for payment purposes at 20.31 hectares. Payment due under the 2001 area-based compensatory allowance scheme, suckler cow premium scheme and special beef premium scheme will issue shortly.

Liam Aylward

140 Mr. Aylward asked the Minister for Agriculture, Food and Rural Development if he will review the application for an SIA grant by a person (details supplied) in County Tipperary; his views on the possibility that there may be an anomaly in the system of unit measurement by his Department; and if he will make a statement on the matter. [4925/02]

Under the terms and conditions of the national scheme of installation aid, applicants must be set up on a farm which has a labour requirement of at least one man work unit and not more than three at the end of the first production year following set up. In the case of the person named, based on information available to the Department, the labour requirement on the farm was 6.86 which exceeds the three man work unit upper limit allowed under the scheme. Therefore, the person named is ineli gible for aid under the terms and conditions of the scheme.

John Ellis

Ceist:

141 Mr. Ellis asked the Minister for Agriculture, Food and Rural Development if his Department will make a payment of suckler cow premium to a person (details supplied) in County Leitrim; and the reason payment has been delayed. [4926/02]

The person named applied for premium for 23 animals under the 2001 suckler cow premium scheme. Following an examination of the application it was found that three animals required further checks with regard to details recorded on the CMMS. A notification has now issued to the person named informing him that his herd will be inspected. The application will be processed further when the inspection details become available.
