Written Answers. - Deportation Orders.

511 Mr. B. Hayes asked the Minister for Justice, Equality and Law Reform his plans regarding the deportation of a person (details supplied) in County Mayo, in view of the fact that this person is an expectant father; and if he will make a statement on the matter. [8244/02]

The person in question arrived in the State on 6 February 2000 and sought asylum. On examination by the asylum division, his case was deemed to be manifestly unfounded and he was notified of this decision on 23 October 2000. He appealed this decision and his appeal was refused by the refugee appeals authority. He was informed of this decision on 16 November 2000. The person in question was informed on 16 November 2000 that it was proposed to make a deportation order in his case. He was given the alternatives of either making representations within 15 working days setting out reasons why he should be allowed to remain temporarily in the State, leaving the State before the Minister decides whether or not to order his deportation, or consenting to the making of a deportation order. An application for leave to remain was submitted by the person's legal representatives on 1 December 2000.

On considering the case file, including numerous representations received from a variety of local individuals and local support groups, I signed a deportation order in respect of the person in question. It is proposed to enforce the deportation order made in respect of the person concerned. I am informed that the Garda national immigration bureau is currently making arrangements for the repatriation of the person concerned to his country of origin.
