Ceist:

550 Dr. Upton asked the Minister for Social, Community and Family Affairs if a person (details supplied) in Dublin 10 is entitled to an orphan's allowance. [9417/02]

A claim for orphan's contributory allowance by the person concerned in respect of her grandson was refused by a deciding officer on the grounds that the child is not an orphan within the meaning of the legislation. A dependent child allowance of €21.60 is, however, in payment to her in respect of the child.

If she is not satisfied with the decision on her claim for an orphan's allowance, she may appeal against it by writing to the Chief Appeals Officer, Social Welfare Appeals Office, D'Olier House, D'Olier Street, Dublin 2, stating the grounds of her appeal.

Under social welfare legislation, decisions in relation to claims are made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
