[12628/02]

An appeal in this case was received in my Department. The file has been re-examined and the original decision was upheld. A letter confirming same issued to the applicant on 12 April 2002.

78 Mr. Deenihan asked the Minister for Agriculture, Food and Rural Development when a fifth year REP scheme payment will be made to a person (details supplied) in County Kerry; and if he will make a statement on the matter. [12629/02]

Following a compliance inspection on this holding on 16 December 1999, a non-compliance penalty amounting to 100% of his fifth year payment under the scheme was imposed on the person named. When he was notified of the penalty he was informed of his right to appeal it, but no appeal was received.
