Vol. 553 No. 2

Written Answers. - Legal Aid Service.

Ceist:

604 Mr. Ahern asked the Minister for Justice, Equality and Law Reform the income eligibility limits for service with separation cases from the Legal Aid Board; when limits were last adjusted; and if there is an appeal for exceptional cases when applications for help are refused. [13385/02]

I can inform the Deputy that the criteria used to determine financial eligibility under the Civil Legal Aid Act, 1995, were last revised on 16 January 2002, and I am sending the Deputy a copy of Statutory Instrument No. 8 of 2002 under separate cover for his information. I can also inform the Deputy that the same means test applies to all legal services provided under the Act, including separation cases. I can also inform the Deputy that the relevant legislation, the Civil Legal Aid Act, 1995, and the regulations made thereunder, do not make any provision for appeals in exceptional cases.
