592 Mr. Carey asked the Minister for Transport the regulations which exist to control the use of motorbikes from being used without exhaust pipes, some of which have been removed deliberately in order to increase the level of noise; and if he will make a statement on the matter. [20197/02]

In accordance with article 29 of the Road Traffic (Construction, Equipment and Use of Vehicles) Regulations, 1963, every vehicle propelled by an internal combustion engine must be fitted with an exhaust silencer or other device suitable and sufficient for reducing to a reasonable level the noise caused by the escape of exhaust gases from the engine. Under article 85 (4) of these regulations it is not permissible to use a vehicle where the exhaust gases from the engine do not pass through an exhaust silencer or other device required to be fitted by article 29. Failure to comply with these provisions are offences under the Road Traffic Act, 1961, enforcement of which is the responsibility of An Garda Síochána.
