146 Mr. Naughten asked the Tánaiste and Minister for Enterprise, Trade and Employment if her Department or agencies under the aegis of her Department have carried out or are carrying out, an investigation into companies (details supplied) which have never filed annual returns to the Companies Office; and if she will make a statement on the matter. [19993/02]

I understand the first named company was dissolved on 7 May 1999 for failure to file annual returns. This company filed its last annual return on 27 October 1994 made up to 30 June 1994. The second named company was dissolved on 23 April 1999 for not filing annual returns. I understand that this company never filed an annual return from the time of its incorporation on 17 February 1992.

Following the establishment of the Office of the Director of Corporate Enforcement on 28 November 2001, responsibility for company law investigations rests with the Director of Corporate Enforcement. The Deputy will appreciate that under the Company Law Enforcement Act, 2001, the director is independent in the discharge of his duties and I am not in a position to say whether or not the director is carrying out, or has carried out, an investigation into either company.
