Denis Naughten

Ceist:

382 Mr. Naughten asked the Minister for Transport if he will appoint a mediator to resolve the dispute between Aer Rianta and the regulator (details supplied) regarding landing charges; and if he will make a statement on the matter. [22241/02]

Subject to the Aviation Regulation Act, 2001, and as provided for in that Act, the regulator acts on an independent basis in the exercise of his functions. Section 38 of that Act provides for the right of any party to question the validity of the regu lator's determination by way of an application for leave to apply for a judicial review to the High Court.

Aer Rianta sought and secured leave from the High Court for a judicial review of the Aviation Regulator's determination of August 2001 in relation to airport charges at the State airports. I understand that the case is due to be heard shortly. I will give full consideration to the Deputies suggestion.
