188 Mr. Sargent asked the Minister for the Environment and Local Government the number and nature of complaints against Ireland relating to Directive No. 75/442/EEC. [24093/02]

At present my Department is dealing with 19 complaints which have been registered by the European Commission and which, to one extent or another, involve Council Directive No. 74/442/EEC on waste. The circumstances of each case differ and in some instances a number of issues arise for consideration. These complaints concern the transposition and interpretation of Directive No. 75/442/EEC, the siting of waste facilities, the granting of and compliance with waste licences and permits, and unauthorised waste activities.

The European Commission registers all complaints made to it. The registration and subsequent referral of a complaint to the member state concerned does not indicate, prima facie, that the complaint necessarily is well founded.
