255 Mr. Timmins asked the Minister for Communications, Marine and Natural Resources if all construction contracts under the control of his Department, have in place a satisfactory safeguard to ensure that any waste material from excavation works is being disposed of in a correct manner; if such a procedure is entitled in any relevant contract. [26679/02]

All construction contracts under the control of my Department have in place measures to ensure that any waste material from excavation works is disposed of in a correct and appropriate manner.

In the case of works carried out by contract, my Department's standard contract conditions contain clauses to the effect that waste shall be disposed of in accordance with procedures agreed in advance with my Department's engineering division.

In the case of the large works currently under construction at Killybegs, County Donegal, for my Department, waste arising from excavation and dredging works is disposed of in accordance with a dumping at sea permit and a waste licence issued by the Environmental Protection Agency.
