Gerard Murphy

Ceist:

212 Mr. Murphy asked the Minister for Agriculture and Food if all outstanding moneys for reactor cattle will be awarded to a person (details supplied) in County Cork. [27148/02]

The person referred to has only recently furnished to the district veterinary office the required documentation to enable the payment to be made. This has now been processed and payment will issue shortly.

213 Mr. Murphy asked the Minister for Agriculture and Food if all outstanding payments for area aid will be made to a person (details supplied) in County Cork. [27149/02]

No area aid application was received in my Department from the person named for the 2002 scheme. Consequently no payment under the 2002 area-based compensatory allowance scheme can be made to him. The person concerned was not an applicant for suckler cow or ewe premium.

One animal was found to be eligible in the case of the person named under the 2001 slaughter premium scheme. EU regulations governing the scheme require a producer acknowledgement to be completed by the herdowner to enable participation in the scheme. To date, no producer acknowledgement has been received for the person named. No animals were found to be eligible in this case under the 2002 slaughter premium scheme.

Bernard Allen

Ceist:

214 Mr. Allen asked the Minister for Agriculture and Food the number of farms grant aided for waste management; and the land area involved as of the end of September 2002. [27150/02]

Up to the end of September 2002, 4,808 applications had been received by my Department under the farm waste management scheme, which was established pursuant to the National Development Plan 2000-2006. Payments had been made in 845 of those cases, by end-September 2002, at a cost of €6.355 million. The land area involved in those 845 cases is 40,000 hectares approximately.

Seán Ryan

Ceist:

215 Mr. S. Ryan asked the Minister for Agriculture and Food when a decision will be made in relation to an application submitted by a person (details supplied) in County Cork for compensation resulting from the culling of this person's herd following a BSE infestation; and when a decision will be made relating to this person's milk quota. [1015/03]

Compensation in respect of animals slaughtered as a result of BSE issued to the person concerned on 22 October 2002.

In relation to the milk quota, it is possible for herdowners to temporarily lease an unused part of their milk quota to their milk purchaser for the current quota year. The herdowner in this case was advised by letter on 10 December 2002 that this can arranged by contacting the relevant milk purchaser.

Ned O'Keeffe

216 Mr. N. O'Keeffe asked the Minister for Agriculture and Food the reason payment of the 2001 beef premium has not issued to a person (details supplied) in County Cork. [1023/03]

The person named submitted one application for 2001 special beef premium in respect of ten animals. The area aid application of the person named indicates that the total forage area for premia payment purposes is 24.34 hectares thus entitling the person named to a total of 48.68 reckonable livestock units, i.e. 2.0 livestock units of premium per hectare. The milk quota of 41,307 gallons of the person named utilises 47.15 livestock units, 41,307 divided by the national average yield of 876 gallons. This left a total of 1.53 reckonable livestock units for special beef premium purposes which entitled the person named to a reduced payment on 2.55 animals, 1.53 divided by 0.6.

The person named was paid his full entitlements under the 2001 slaughter premium scheme and national envelope.

Bernard J. Durkan

217 Mr. Durkan asked the Minister for Agriculture and Food if he will review the REP scheme application of a person (details supplied) in County Mayo; and if he will make a statement on the matter. [1083/03]

The person named failed to submit his second-year REPS payment application form within the required timeframe. Consequently my Department had no alternative but to terminate his participation in 1998 and seek full recoupment of the payment he had already received. He was reminded of the overpayment on a number of occasions since then but my Department has no record of any correspondence from him in reply and my Department will be pursuing the matter further with the person named.

Under the EU rules governing the rural environment protection scheme, the annual submission of a payment application form within a specified timeframe is a mandatory requirement. Failure to abide by the scheme conditions in this regard means that all aid paid must be recouped.
