Ceist:

85 Mr. Kenny asked the Minister for Justice, Equality and Law Reform if he will consider amending the Intoxicating Liquor Act 2000 in respect of the number of cases (details supplied) in respect of six-day licences; and if he will make a statement on the matter. [2207/03]

The position is that section 19 of the Intoxicating Liquor Act 2000 made provision for the upgrading of restricted licences subject to compliance with certain prescribed conditions. One of these conditions was that the holder of the restricted licence was required to satisfy the Revenue Commissioners that he or she held the restricted licence for the whole of the period of five years preceding commencement of that section.

Since the entry into force of section 19 of the 2000 Act, my Department has been made aware of a number of cases in which the upgrading of a restricted licence has been refused by the Revenue Commissioners on the grounds of non-compliance with the five year rule.

As the Deputy may be aware, I have already announced a comprehensive codification of the entire liquor licensing code and I will consider how best to overcome difficulties that have arisen in relation to the upgrading of certain restricted licences in that context.
