asked the Minister for Justice, Equality and Law Reform his plans to review pub and club opening hours, having regard to concerns among the public that the later closing times have led to an increase in street violence and crime; and if he will make a statement on the matter. [2908/03]

The Commission on Liquor Licensing made no recommendations for changes in general trading hours in its second interim report which was published in July. The commission did state that it would return to the issue in its final report which is expected in mid-March.

As part of the process of reviewing existing trading hours provisions and assessing the need for further changes, the commission placed advertisements in national newspapers last autumn inviting views and submissions on the trading hours issue. A large number of submissions were received both from individuals and a broad range of interested bodies. A number of organisations were subsequently invited to make oral presentations. At present the commission is considering the views and submissions received in the context of preparing its final report. On receipt of this report I will consider any recommendations for changes in existing legislative provisions that are made by the commission.

On the subject of street violence and crime, the position is that extensive powers are available to the Garda to deal with late night drinking and disturbances under the Criminal Justice (Public Order) Act 1994. As the Deputy is no doubt aware, the Criminal Justice (Public Order) Bill 2002, will, when enacted, give the Garda significant additional powers in dealing with drunkenness and public disorder. The Bill completed Second Stage in December and has been referred to the Select Committee on Justice, Equality, Defence and Women's Rights.
