Written Answers - Milk Quota.

207 Mr. Kehoe asked the Minister for Agriculture and Food further to Parliamentary Question No. 224 of 18 February 2003, if a person (details supplied) in County Wexford were to transfer land with milk quota over to their son (details supplied), if this would comply with regulations; and if he will make a statement on the matter. [8163/03]

The European Communities (Milk Quota) Regulations 2000, as amended, set down the detailed rules for the transfer of milk quotas. The regulations state that where land is transferred between family members, the milk quota attached to those lands is also transferred. Where part of a holding is transferred, only the milk quota attached to that part is transferred. The regulations also set out how to establish the amount of quota attached to lands. It would be necessary to have details of both the milk quota held and the lands in question to confirm the amount of milk quota that transfers in specific circumstances. If the named person's wish is to have further clarification, they should contact the milk policy division of my Department.
