183 Mr. Deenihan asked the Minister for Agriculture and Food when headage grant payments will be made to a person (details supplied) in County Kerry; and if he will make a statement on the matter. [13562/03]

The person named was paid his full entitlement under the 2002 area-based compensatory allowance scheme on 20 September 2002.

The person named applied for premium on 11 animals under the 2002 suckler cow premium scheme. An 80% advance payment of €1,972.52 issued on 31 October 2002. However, following an inspection, four unclaimed animals in the herd were found to be non compliant with CMMS requirements, incurring a 26.56% penalty. The person named incurred a penalty of €654.87 on a total payment due of €2,465.65. As a result, no balancing payment can issue and the person has in fact been overpaid €161.74.
The person named applied for premium on 1 animal under the 2002 special beef premium scheme. An 80% advance payment of €120 issued to the person named on 16 October 2002. As a consequence of the application of the penalty, linked to the CMMS non-compliant unclaimed animals, across all the bovine schemes a 26.56% reduction penalty was also imposed on the special beef premium application of the person named. When applied to the special beef premium application, the person named incurred a penalty of €39.84 on a total payment due of €150. As a result, no balancing payment can issue and the person has in fact been overpaid €9.84.
The person named participated in 2002 extensification premium opting for the simplified system. Payment of this premium is scheduled to commence in June 2003.

184 Mr. McGuinness asked the Minister for Agriculture and Food if he will expedite payment to a person (details supplied) in County Kilkenny whose herd failed a test recently; if the arbitration process can also be expedited in view of the hardship of the case; and if he will make a statement on the matter. [13639/03]

Both my Department and the person concerned have agreed to accept the appeal valuation carried out on 24 April 2003 on the TB reactors involved. There is therefore no requirement by either party to invoke the arbitration process provided for under the on-farm market valuation scheme. The local district veterinary office has requested certain documentation, which is necessary before payment of the reactor compensation can be made, from the person concerned. As soon as this documentation is received, the payment will be processed.
