208 Mr. Gormley asked the Minister for Finance if he will consider providing greater transparency by requiring that a notice be placed on a relevant property or by providing a list of applications on his Department's website or by requiring consultation with the local authority in respect of applications for waivers of the State's interest in property vested in the State under the State Property Act 1954. 209 Mr. Gormley asked the Minister for Finance if he will consider automatically transferring the interest in property to a local authority, which in most cases would have taken on the responsibility of maintaining common area in situations whereby the common area of a housing estate has been vested in the State under the State Property Act 1954. [14259/03]

I propose to answer Questions Nos. 208 and 209 together.

Applications for waivers of the State's interest in property vested in the State on the dissolution of a company are dealt with by my Department in accordance with the provisions of the State Property Act 1954. The merits of each application are carefully considered subject to the legal advice of the Chief State Solicitor. The particular circumstance in each case determines the level of consultation reasonably required. Where it is considered appropriate, the local authority is invited to apply for a waiver. However, I am prepared to have the suggestions set out in the questions examined.
