249 Mr. Kenny asked the Minister for Justice, Equality and Law Reform if he has satisfied himself that controls are in place to ensure that ammonium nitrate in imported blended fertilisers cannot be used in subversive activity; if this material cannot be moved into Northern Ireland; and if he will make a statement on the matter. Ammonium nitrate blended fertilisers containing more than 79% by weight of ammonium nitrate are deemed to be an explosive in accordance with S.I. No. 191 of 1972 – the Explosives (Ammonium Nitrate and Sodium Chlorate) Order, 1972 – and, consequently, may not be imported into the State without an importation licence issued under the Explosives Act 1875. Movement of this material into Northern Ireland may not take place except under and in accordance with the terms of a licence from the Northern authorities. I am advised by the Garda authorities that the measures currently in place are sufficient to prevent the substance's possible use for subversive purposes.
