Adjournment Debate. - Outdoor Events.

53 Ms Lynch asked the Minister for the Environment Heritage and Local Government the terms and conditions attached to the licence for a concert (details supplied) in the Phoenix Park in August 2003; the total amount paid in rent or other fees by the promoters; if a licence for a privately run event in a public facility such as the Phoenix Park will specify that patrons should not be subject to a booking fee for tickets; and if he will make a statement on the matter. The licence for this concert by my Department was granted subject to compliance in full with the provisions of the Phoenix Park Act 1925, the Phoenix Park Bye Laws 1926, the terms and conditions set down by Dublin City Council in their licence for a public outdoor event under Part 16 of the Planning and Development Regulations Act 2001, my Department's policy document of May 1997 governing large-scale public events in the Phoenix Park, and the specific terms and conditions set down by my Department for the event.

The terms and conditions for the latter licence are quite lengthy and I propose to make a copy of them available to the Deputy apart from some figures which may be commercially sensitive.

As stated in reply to Parliamentary Question No. 502 on 7 October 2003, a substantial fee in excess of the normal commercial rate was received for the Phoenix Park concert of August 2003. The amount of the fee is commercially sensitive information, which could prejudice the competitive position of the promoter and the Department's negotiating position for future events.

In accordance with standard procedures, my Department will bring the relevant item to account in the context of the appropriation account for the current year. This will, in the normal course, be subject to audit by the Comptroller and Auditor General.

The issue of booking fees for tickets is not controlled by my Department and is entirely a matter for the promoter.
