253 Mr. Neville asked the Minister for Health and Children further to Questions Nos. 215 and 220 of 9 April 2003, if the chief executive officer of the Mid-Western Health Board will respond to the letter from the Chief State Solicitor sent on 4 June 2002, details supplied. [28340/03]

I previously informed the Deputy on 9 April 2003 that, arising from the change in solicitors acting on behalf of the Mid-Western Health Board, the Chief State Solicitor's office, CSSO, was unable to obtain further information to help progress this matter further. I wish to inform the Deputy that the Department has contacted the Mid-Western Health Board with a proposal, which was subsequently agreed, that the CSSO may correspond directly with the board's firm of solicitors. The Department advised the CSSO of this development and the Chief State Solicitor has recently informed the Department that they have now written to the board's solicitors regarding ownership of the lands at Gotoon, Kilmallock.

I have communicated the Deputy's request for a response regarding the letter sent on 4 June 2002 by the CSSO to the chief executive officer of the Mid-Western Health Board. I have requested the chief executive officer to reply directly to the Deputy as a matter of urgency.
