118 Mr. N. O'Keeffe asked the Minister for Agriculture and Food if he will consider under appeal an application for a ministerial declaration of approval to make a temporary transfer of milk quota in the 2003-04 milk quota year in respect of a person (details supplied) in County Cork. [31509/03]

In general, a milk producer may temporarily lease a milk quota in its entirety for one year only. An entire quota may only be leased for a second year when, on application, the quota holder shows that he cannot resume production in the second year due to exceptional circumstances but intends to resume in the near future.

While an application was received from the person named, it was not received by the specified closing date nor did it indicate that he intended to resume milk production in the future. In these circumstances permission to temporarily lease the quota for a second year was not granted.

The position is, therefore, that unless deliveries are made against this quota or it is transferred in the current quota year, it may be taken into the national reserve as from 1 April 2004. However, if the person named or his successor were to commence milk deliveries after that date but within two years of it, all or part of that quota could again be made available to him.
