For the information of Members, I wish to advise that I received a message from the President stating that pursuant to Article 26 of the Constitution and after consultation with the Council of State, he had referred sections 9, 10, 39, 40(2), 42, 43, 45, 46, 47, 51, 57 and 58 of the Judicial Appointments Commission Bill 2022 to the Supreme Court for a decision on the question as to whether the said sections of the Bill were repugnant to the Constitution, or any provision thereof.
I subsequently received a message from the President informing me that the Supreme Court had decided that sections 9, 10, 39, 40(2), 42, 43, 45, 46, 47, 51, 57 and 58 of the Judicial Appointments Commission Bill 2022 were not repugnant to the Constitution or to any provision thereof, and that he had accordingly signed the Bill on 8 December 2023.
