Railway Fires (Amendment) Bill, 1931—Committee.

I think I am correct in stating that the Committee Stage of this Bill was postponed earlier in the day for the attendance of the Minister in charge of it. Senator Comyn then indicated that he wished to raise some question in connection with the Bill. The Minister is now present, but unfortunately Senator Comyn is not. I suggest that the Bill be not taken until Senator Comyn is in attendance.

The point made by Senator Comyn, I think, was that under the Bill as it stands anybody whose property was damaged to an extent greater than £200 has no remedy at all. That seems a rather curious interpretation of the Bill. That was the point the Senator raised. He said he wished to move an amendment, but surely that is a matter that can be considered on the Report Stage of this Bill.

If Senator Comyn wants to amend the Bill in a particular way he can seek to do so on the Report Stage.

Is it not a fact that if a person's property is destroyed and the damage done is over £200, he is not limited at all as to the amount he can recover if he can prove neligence.

Yes, and that is why I cannot understand Senator Comyn's reason for wanting to bring up the amendment.

Provided it is understood that Senator Comyn can move the amendment that he mentioned on the Report State, I have no objection to the Committee Stage being taken now.
