2. (1) Taréis dom deimhniú dar dáta ar lú lá de Lúnasa, 1944, d'fháil ón gCeann Cóimhrimh Seanaid ar ainmneacha na n-iarrthóirí do toghadh go cuibhe chun na n-ainmliost uile agus fé seach, fuaras amach gurb aon duine amháin Tomás Condún, Dún Riabhach, Co. na Midhe, do toghadh chun fo-ainmliost na gcomhlucht ainmniúcháin den Ainmliost Tionnscail agus Tráchtála agus Tomás Condún, comhalta liostaithe de Bhord Cuartaíochta na hÉireann do bunaíodh fén Acht um Thrácht Cuartaíochta, 1939, agus a dtagann de dhuine bheith ina chomhalta dhe an duine sin do bheith, fé Alt 5 den Acht san, dí-cháilithe chun bheith ina chomhalta de cheachtar Tigh den Oireachtas. Ó fuaireas eolas go hoifigiúil ón Roinn Tionnscail agus Tráchtála go raibh Mac Uí Chondúin ina chomhalta fós de Bhord Cuartaíochta na hÉireann an lú lá de Lúnasa, 1944, níor chuireas chuige an fógra a hordaítear le fo-alt (2) de Bhuan-Ordú Uimh. 1 de na BuanOrduithe bhaineann le Gnó Poiblí chun teacht i láthair chun Rolla na gComhaltaí do shíniú. Fé fhorála Ailt 34 d'Acht Toghcháin an tSeanaid (Baill Ainmliosta), 1937, is tuigthe, de bhíthin na dí-cháilíochta ghabhann le Mac Uí Chondúin, é d'éirí as bheith ina chomtalta de Sheanad Éireann díreach taréis é thoghadh chuige amhlaidh.

2. (1) After receipt from the Seanad Returning Officer of his certificate dated 1st day of August, 1944, of the names of the candidates duly elected to the several panels, I became aware that Mr. Thomas Condon, Ashbourne, Co. Meath, elected to the nominating bodies sub-panel of the Industrial and Commercial Panel, was one and the same person as Mr. Thomas Condon, a listed member of the Irish Tourist Board, constituted under the Tourist Traffic Act, 1939, membership of which is a disqualification under Section 5 of that Act, for membership of either House of the Oireachtas. Having ascertained officially from the Department of Industry and Commerce that Mr. Condon was on the 1st day of August, 1944, still a member of the Irish Tourist Board I did not issue to him the notice prescribed by sub-section (2) of Standing Order No. 1 of the Standing Orders relative to Public Business to attend for the purpose of signing the Roll of Members. Under the provisions of Section 34 of the Seanad Electrol (Panel Members) Act, 1937, Mr. Condon, in consequence of the disqualification attaching to him, is deemed to have vacated his membership of Seanad Éireann after his said election thereto.

(2) I have laid upon the Table the relative certificate from the Secretary to the Department of Industry and Commerce.

3. I gcomhlíonadh Buan-Ordú 3 de na Buan-Orduithe i dtaobh Gnótha Phoiblí táim tar éis cóipeanna de na deimhnithe ar thorthaí na vótaíocht do chomhaltaí toghtha do leagadh ar an mBord.

3. In compliance with Standing Order No. 3 of the Standing Orders relative to Public Business, I have also laid upon the Table copies of the certificates of the results of the polls for elected members.
