Air Navigation and Transport (Preinspection) Bill, 1986: Motion for Earlier Signature.

I move:

"Go gcomhthoilíonn Seanad Éireann, de bhun fho-alt 2º d'Airteagal 25 den Bhunreacht, leis an Rialtas in achainí chun an Uachtaráin go gcuirfidh sé a lámh leis an mBille Aerloingseoireachta agus Aeriompair (Réamhiniúchadh), 1986, níos luaithe ná an cúigiú lá tar éis an dáta a thairgfear an Bille dó.

On previous occasions on which I have had occasion to move early signature motions as Leader of the House I have indicated that I always do it with reluctance as I do now. It is one of the functions of an Upper Chamber to exercise some sort of a watching brief for the Constitution. I have to say in this instance, as I said in every other instance, that I believe that the President, who is in a sense the Third House of the Oireachtas should not be abridged in the time available to him for consideration of legislation and the exercise of the very small discretion which the Constitution allows to him. Accordingly, as usual, I move this motion with reluctance.

The reason the Government have sought the concurrence of the Seanad is that, as the Minister of State has indicated, it is proposed to put this agreement into operation on 1 July. In order to allow that to happen it is necessary that the President should sign the Bill. It is also necessary that a ministerial order be made under section 3 of the Bill. These things must all be done so that the experiment can start on 1 July. I understand that it was due to the hogging of time by the Finance Bill in another place which led to the fact that this Bill was late coming to us. Having expressed regret about it, we have to face the circumstances in which we find ourselves. These circumstances are that there is not the normal time available to the President for consideration of the Bill. Accordingly, the Government have asked for the concurrence of Seanad Éireann in requesting the President for an early signature.
