SECTION 52.

I move amendment No. a32f.:

In page 43, subsection (1) (a), line 1, to delete "A company may refuse" and substitute "The Harbour Master may refuse".

I propose this amendment because the harbour master must be able to give a direction to a ship rather than the company, as is implied in the section. I wish to hear the Minister's views on the amendment before commenting further.

Perhaps the Minister might clarify some of the points being raised in the amendment.

I have no difficulty in accepting the amendment but there may be some consequential amendments to the section. The words "a company" on lines 14 and 24, for example, should be amended to read "the harbour master". If the Chairman wishes I can propose such an amendment now. Alternatively, I can amend it on Report Stage.

It would be preferable to do that on Report Stage.

I am pleased the Minister accepts the amendment.

SECTION 55.

I move amendment No. 32f.:

In page 45, subsection (1), line 3, after "Sixth Schedule" to insert ", unless the context otherwise requires".

This is a technical amendment. In section 55 (1), pilot's licence is defined as meaning a licence granted under section 58 (a). However, reference is also made in section 58 to pilots' licences granted by the former pilotage authority under the Pilotage Act, 1913. The insertion of the words "unless the context otherwise requires" on line 3 is necessary for clarification purposes.
