Business of Select Committee.

Before we recommence the debate on the Bill there is a procedural point on which I wish to advise Members. Further to our discussion last week on Report Stage amendments, I would like to provide clarification for members on the subject based on further research carried out on it.

As Chairman of the Select Committee I am responsible only for procedure in this committee and not for procedure in the Dáil, which is a matter for the Ceann Comhairle. Furthermore, I am unable to give advice to Members on hypothetical questions and it would be inappropriate for me to give assurances or guarantees in regard to Report Stage amendments as it is clearly outside my powers; it is a matter for the Ceann Comhairle. Whether Report Stage amendments are in order is a matter for the Dáil.

On the submission of Report Stage amendments, I can indicate to Members that, in general, such amendments are in order only if, inter alia, first, they do not involve a charge on the Revenue — that is in accordance with Standing Order 106 — and, second, they have been discussed on Committee Stage, whether the amendment was lost or withdrawn is not relevant. That derives from the long standing rulings of the Chair.

It is a matter for the Ceann Comhairle as to whether amendments may be resubmitted on Report Stage.

Will that information be circulated?

Yes. There was a certain vagueness about the issue yesterday and I felt I should go into the matter in detail.
