SECTION 80.

I move amendment No. 105:

In page 63, subsection (1), line 18, after "meeting" to insert "to the Registrar,".

At present the subsection provides that the secretary of a credit union give notice of annual general meetings and special general meetings to the auditor and every member of the credit union. The prison service credit union pointed out that the notice of every general meeting should also be required to be given to the registrar having regard, inter alia, to his right in section 82(1) to attend and speak at any general meeting. The purpose of the amendment is to correct this omission.

I move amendment No. 106:

In page 63, subsection (2)(c), line 25, before "shall" to insert "in the case of a notice of a special general meeting,".

The Irish League of Credit Unions, the Credit Union Advisory Committee and the Telecom Éireann credit union have drawn my attention to the inconsistency between section 78(5), which requires that a copy of the annual accounts be circulated to every credit union member with notice of the annual general meeting, and section 80 (2)(c) which requires notice for general meetings which includes annual general meetings to contain a statement that the annual accounts be obtained at the registered office of the credit union not later than seven days before the date of the general meeting. The primary purpose behind the need for this latter provision is to deal with a special general meeting called to consider the financial position of a credit union. In such a case the latest audited accounts should be available to members and the purpose of this amendment is to make it clear that section 80 (2)(c) only relates to special general meetings and not to annual general meetings covered by section 78 (5).
