SECTION 66.

I move amendment No. 81:

In page 65, subsection (3) (c), line 40, to delete "the exercise of a right so conferred" and substitute "a member of the Garda Síochána in the lawful exercise of a power conferred on him".

This is a drafting amendment, the purpose of which is to align the wording of subsection (3) (c) with the wording of section 66.

Does the section give the Garda authorities the right to go to places, on behalf of banks, and carry out searches?

Yes. if investigations are being impeded or obstructed and one must go to the Garda authorities who will issue a search warrant.

Is it the same as a court warrant?

Yes. A District Judge will issue a warrant to the Garda authorities.

The provision, therefore, is not more powerful in terms of current procedures for getting a search warrant?

No, it is the ordinary standard provision from the point of view of getting a search warrant. The same provision is included in the Companies' Act.
