SECTION 2.

I move amendment No. 1 :

In subsection (1), page 4, to delete line 29 and substitute the following definition :

"‘ Act ' includes default or other omission;".

This is a drafting amendment. " Default " is a commonly used legal expression. Consequential on this amendment are the amendments to sections 50 and 51, in each of which it is proposed to delete " neglect or default ".

I move amendment No. 2 :

In subsection (1), page 5, line 7, before the definition of " liable " to insert the following new definition: "‘ injured person ' means a person against whom a wrong is committed."

This is a drafting amendment designed to make it clear that " injured person ", which appears throughout the Bill, does not mean a person who suffers personal injuries. It includes such a person, of course. The amendment is necessary to avoid any confusion arising from the definition of " personal injury " and the construction of "injured" in that definition.
