Special Committee Wildlife Bill, 1975 díospóireacht -
Tuesday, 2 Nov 1976

SECTION 67.

Question proposed: "That section 67 stand part of the Bill."

The purpose of this section is to eliminate overlap between the Bill—in particular section 45 which restricts the sale of protected wild birds and wild animals and section 46 which empowers the Minister to regulate and control wildlife dealing—and Part V of the Protection of Animals (Amendment) Act, 1965 which regulates the sale of pet animals, whether they be domestic or wild species. The technique used is simply to declare that the provisions of the 1965 Act will not apply to protected wild birds and protected wild animals. It follows that the sale of any pest species of wild bird or wild animal in common with domestic or pet animals and birds will continue to be regulated under Part V of the Protection of Animals (Amendment) Act, 1965.

I thought that was covered in other sections we have passed.

No, we are making that clear. If we did not pass this section we would have overlapping between the Act of 1965 and the present Bill. We are taking the pest species and the domestic pets out of this Bill and leaving them in the Protection of Animals (Amendment) Act of 1965.

Question put and agreed to.
