Ceisteanna (434)

Tony Gregory

Ceist:

575 Mr. Gregory asked the Minister for the Environment, Heritage and Local Government if all construction work on development sites in residential areas will take place between 8 a.m. and 6 p.m. except in exceptional circumstances regardless of whether planning permission has been granted by a local authority or by An Bord Pleanála; and if he will make a statement on the matter. From an environmental or development control point of view, there is no general statutory requirement limiting construction work on development sites in residential areas to specific times and there are no proposals in that regard. However, as detailed in reply to Question No. 385 of 6 April 2004, the Planning and Development Act 2000 enables planning authorities to impose planning conditions on a permission to reduce or prevent noise emissions and there are other provisions, particularly under the Environmental Protection Agency Act, which may also be utilised.
