629 Mr. Sargent asked the Minister for the Environment, Heritage and Local Government if his Department will release letters of formal notice and reasoned opinions in the circumstances outlined by European Commissioner Ms Margot Wallstrom (details supplied). [28888/04]
Amharc ar fhreagraOn the basis of legal advice, my Department does not divulge details of correspondence with the European Commission in connection with EU complaints or infringement proceedings while these are still active. When such complaints or infringement proceedings are terminated or cease to be active, the release of correspondence is open to request by interested parties and consideration by my Department, subject to any applicable exemptions under Freedom of Information legislation or, where appropriate, the regulations on access to environmental legislation.
