228 Mr. Kenny asked the Minister for Finance the conditions that must be met to allow for the alteration of university statutes, in cases in which such alteration might have an implication for public service retirement age; if consent for any such alteration must be received from his Department; and if he will make a statement on the matter. The alteration of university statutes is, in general, a matter for the relevant governing body. However, if the alteration of a statute concerns a change in pension terms or retirement age, it would be deemed to be an amendment to the pension scheme and would, therefore, under the provisions of the Universities Act 1997, require the approval of the Higher Education Authority and the consent of the Ministers for Education and Science and Finance.
