371 Mr. Wall asked the Minister for Justice, Equality and Law Reform when the passport of a person (details supplied) in County Kildare will be returned to them as they require it for their application for housing with their local authority; and if he will make a statement on the matter. The person concerned entered the State in May 2003 and claimed asylum. On 29 October 2003 it was decided by the Refugee Applications Commissioner that the person's application should be transferred to Germany in accordance with the provisions of article 8 of the then Dublin Convention. Germany agreed to accept responsibility for the application. The person appealed the decision which was considered by the Refugee Appeals Tribunal. The Refugee Appeals Tribunal decided to uphold the original decision and the person was informed of this on 20 January 2004.

Before the person could be transferred to Germany, his country of origin, the Czech Republic, joined the EU on 1 May 2004. As a result of this, he now enjoys EU Treaty rights in Ireland for the purpose of seeking employment or self-establishment. The person concerned should contact the Department on 13/14 Burgh Quay, Dublin 2, telephone 616 7700, for the purpose of making arrangements for the return of his passport.
