O’Keeffe asked the Minister for Communications, Marine and Natural Resources if ministerial approval has been granted or refused in respect of the request in May 2005 by the Dublin Port Company for the approval of the arrangement it entered into without going through the normal tendering process with the Anna Livia consortium to facilitate its bid for the national conference centre contract together with further and complementary commercial development; and if he will make a statement on the matter. I propose to take Questions Nos. 106 and 187 together.

As the Deputy will no doubt recall, I outlined in detail the background to this matter during an Adjournment debate in this House on 28 June 2005. I can inform the Deputy that some advice was received from the Attorney General on 29 July 2005 in this regard and further advice is awaited.

A reply to the Dublin Port Company letter of 18 May 2005 requesting ministerial approval in this matter will issue when all the necessary advice is to hand and fully considered.
