731 Mr. Quinn asked the Minister for Enterprise, Trade and Employment if EU Directive 2001/84/EC was implemented before 1 January 2006; if the directive was not implemented by 1 January 2006 the reason Ireland did not meet its obligations to implement this directive before the deadline; and if he will make a statement on the matter. Directive 2001/84/EC, on the resale right for the benefit of the author of an original work of art, has not as yet been transposed. Because of the novelty of such right to Irish law and the directive's provision of options as to how several key aspects may be implemented, transposition by means of primary legislation rather than regulations under the European Communities Act is required. My Department, in consultation with the Office of the Attorney General and Parliamentary Counsel to the Government, is preparing an intellectual property (miscellaneous provisions) Bill intended to transpose this and several other EU directives in the field of intellectual property. It is intended that this Bill will be published in the first half of the year.
