147 Ms Shortall asked the Minister for Health and Children her views on criticisms that a month after Part 2 of the Mental Health Act 2001 was brought into force there remain gaps in the provision which could cause significant difficulties; and if she will make a statement on the matter. [41467/06]
Amharc ar fhreagraThe full provisions of the Mental Health Act 2001 came into operation on 1 November 2006. The Mental Health Act 2001 significantly improves safeguards for persons who are involuntarily admitted for psychiatric care and treatment. The Act changes the procedure for involuntary admissions and provides for an automatic and independent review all involuntary detentions by a mental health tribunal. This brings Irish mental health legislation into line with the European Convention for the Protection of Human Rights and Fundamental Freedoms. A review of the operation of the Act will be carried out in 2007 and any concerns will be examined in this context.
