370 Deputy Mary Upton asked the Minister for Justice, Equality and Law Reform the law regarding the retention of personal data by Internet service providers and mobile telephone operators; if the law as it currently stands allows for these providers to sell or share this data with private or business organisations; and if he will make a statement on the matter. Amharc ar fhreagraThe position is that statutory standards for the protection of personal data are set out in the Data Protection Acts 1998 and 2003. These Acts contain safeguards against unauthorised processing of such data, including disclosure by transmitting, disseminating or otherwise making it available. Moreover, stringent conditions apply where personal data are retained or used for the purpose of direct marketing. Data protection standards are implemented and enforced by the Office of the Data Protection Commissioner.
