86 Deputy Leo Varadkar asked the Tánaiste and Minister for Enterprise, Trade and Employment her views on the UK Government proposal to introduce a de minimis threshold to exempt small companies from the EU’s accounting and auditing company law directives, specifically the 4th Council Directive 78/660 and the 7th Council Directive 83/349; and if she will make a statement on the matter. In order for any Member State to introduce a de minimis threshold to exempt small companies from the requirements of EU Council Directives 78/660/EEC and 83/349/EEC, it would first be necessary for these Directives to be amended to allow for this exemption. These Directives have not been so amended.

From enquiries made by my Department, I understand that the UK, for the reason cited above, is not proposing to introduce a de minimis threshold to exempt small companies from the requirements of Council Directives 78/660/EEC and 83/349/EEC.

I understand that the UK Government would want to consider how best to respond to any changes to these Directives should these come forward from within the EU at a later date.
