352 Deputy Terence Flanagan asked the Minister for the Environment, Heritage and Local Government if he will clarify the position in respect of when owners of properties purchased under local government affordable housing schemes would have to pay their local authority a clawback if they were to remortgage their properties; and if he will make a statement on the matter. Legislative provision to facilitate arrangements under which a local authority could agree to its clawback charge ranking in second place behind a new or topped-up mortgage charge, thereby facilitating persons in affordable housing wishing to re-mortgage with a private lender, is included in the Housing (Miscellaneous Provisions) Bill 2008 which is currently before the Oireachtas and is targeted for enactment by the Summer recess. This provision is designed to operate so as to facilitate remortgaging of affordable housing without the clawback becoming payable.
