271 Deputy Fergus O’Dowd asked the Minister for Health and Children the position regarding the non-statutory report into the death of a person (details supplied) at a nursing home in County Dublin; if she will request a copy of this report and place it before the Houses of the Oireachtas in view of the fact that the family of this person have been asked to sign a non disclosure agreement in relation to its contents by the Health Service Executive; and if she will make a statement on the matter. The Health Service Executive engaged Counsel in 2007 to carry out the non-statutory inquiry referred to by the Deputy. The Inquiry's Report was delivered to the HSE in October 2009. Following receipt of the report two of the parties requested that they be allowed make further submissions and these requests were granted. The submissions were made in early 2010 and were considered by the inquiry. It is my clear understanding, from the HSE, that none of the parties are now being asked to sign a non disclosure agreement. The question of dissemination of the Report is a matter for the Executive and I understand that it is considering a number of options for the release of the Report.
