350 Deputy Michael D’Arcy asked the Minister for Justice, Equality and Law Reform the legal costs incurred to date by the publicly funded Commission as a respondent in a case (details supplied) lodged with the Equality Tribunal, such case now being closed, a decision notified to the complainant and respondent respectively by the equality officer assigned to the case and no appeal lodged to the Labour Court within the 42 day time limit; and if he will make a statement on the matter. 352 Deputy Pat Rabbitte asked the Minister for Justice, Equality and Law Reform the legal and other associated costs incurred to date by the Garda Síochána Ombudsman Commission as a respondent in a case (details supplied) lodged with the Equality Tribunal; if his attention has been drawn to the fact this case is now being closed and a decision notified to the complainant and respondent respectively by the equality officer assigned to the case; and if he will make a statement on the matter. I propose to take Questions Nos. 350 and 352 together.

I understand from the Garda Síochána Ombudsman Commission that it incurred approximately €34,000 in legal costs in defending itself in this case.

As a matter of fact I believe it is appropriate to point out that the Equality Tribunal actually found against the claimant and in favour of the Commission in this case.
