443 Deputy Joanna Tuffy asked the Minister for the Environment, Heritage and Local Government if there is a timeframe in legislation within which planning conditions attached to granted retention planning permissions must be fulfilled, from the grant date; if not, his views on introducing such legislation as part of the forthcoming Planning Bill; and if he will make a statement on the matter. Amharc ar fhreagraDevelopment which is not carried out in compliance with the terms of the planning permission for the development is unauthorised development which is an offence under the Planning and Development Act 2000. The Act provides that enforcement action may not be taken in respect of a development for which permission has been granted after seven years beginning on the expiration of the duration of the permission. I am considering what further amendments of these provisions may be required, in relation to quarrying, in the Planning and Development (Amendment) Bill 2009. The Planning and Development Act also provides that proceedings may be commenced at any time in respect of any condition concerning the use of land to which the permission is subject.
