283 Deputy Mary Upton asked the Minister for Finance further to Parliamentary Question No. 108 of 1 December 2010, the number of occasions in each of the past five years that the Revenue Commissioners have published notices of a cancelled licence, as provided by section 23 of the Auctioneers and House Agents Act 1947; and if he will make a statement on the matter. Amharc ar fhreagraI am advised by the Revenue Commissioners that under the Auctioneers and House Agents Acts 1947 to 1973 licences are issued to auctioneers and house agents by their Office. I am further advised by the Revenue Commissioners that under the provisions of section 18 of the Auctioneers and House Agents Act 1947, whenever a Court cancels or suspends a licence or an auction permit, or declares a person to be disqualified from holding a licence, or confirms, annuls or varies any cancellation, suspension or disqualification, the registrar or clerk of the Court shall inform the Revenue Commissioners. Section 23 of that Act provides that the Revenue Commissioners shall, as soon as may be after the cancellation of a licence or an auction permit, publish in Iris Oifigiúil notice of the cancellation.
For the years 2006 to 2010 inclusive, the Revenue Commissioners have no record of having received a notification from the Courts under the provisions of section 18 of the Auctioneers and House Agents Act 1947 and, accordingly, they have not published any notices of cancelled licences for the years in question.
