Ceist:

96 Deputy Bernard J. Durkan asked the Minister for Social Protection if he will, in the course of current appeal take into account the compelling evidence submitted by an organisation in the case of a person (details suppled) in County Kildare; and if he will make a statement on the matter. I am advised by the Social Welfare Appeals Office that an oral hearing of this case took place on 11 January 2011 and the Appeals Officer is now considering the appeal in the light of all the evidence submitted, including that adduced at the oral hearing. The additional evidence received by the Appeals Office on 24 January 2011 will also be considered by the Appeals Officer.

The person concerned will be notified of the Appeals Officer decision when the appeal has been determined. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.
