61 Deputy Pat Deering asked the Minister for Education and Skills the rights or entitlements a recently dismissed resource teacher (details supplied) has, who has been employed by him for 22 years with the last 11 full-time in the same school and who is only nine months away from being fully qualified. The appointment of teachers to fill teaching posts is a matter for the individual school authority subject to agreed procedures and must take account of all appropriate legislation. The Board of Management of the school is responsible for recruitment, selection, appointment, discipline and dismissal of staff. It is the policy of my Department that only registered and qualified personnel should be employed by schools as set out in Circular 31/2011. This policy does not, however, overrule existing employment rights.

In response to representations made by the Deputy in May, my Department advised that the person concerned should contact her Board of Management about the possibility of entitlement to a Contract of Indefinite Duration. Her entitlements would depend upon her service and the content of any contracts which she may have had with the school. Where the Board have refused a Contract of Indefinite Duration then it is open to the individual to appeal this decision under the terms of Circular 47/2006.
