398 Deputy Seán Conlan asked the Minister for Agriculture, Food and the Marine the reason a person (details supplied) in County Monaghan has not received his or her single farm payment since 2006; and if he will make a statement on the matter. [31963/11]
Amharc ar fhreagraSingle Payment Scheme applications were submitted for the years 2005, 2006 and 2007 on behalf of the late father of the person named. As the herd-number was transferred to the person named on 3 May 2007, Single Payment Scheme applications for the years 2008, 2009, 2010 and 2011 were submitted in the name of the person named. An application to transfer the Single Payment entitlements to the person named from his late father was submitted under the 2008 scheme year but it has not been possible to complete the requested transfer.
Outstanding payments for the years 2005, 2006 and 2007 are due to the estate of the father of the person named. These payments can only be released upon receipt of normal testamentary documents, i.e. Will and Probate or Letters of Administration. Similarly as the transfer of entitlements is by way of inheritance, the same documents are required.
The Inheritance Enquiry Unit of my Department has made contact with the person named on several occasions and has written to, and spoken with, the solicitor administering the estate of his late father. In addition the Transfer of Entitlements section has written to the person named on three occasions. The requirements of the Department have been clearly stated on all occasions but to date the testamentary status of the estate of the late father of the person named remains unclear and the relevant documents have not been submitted.
The person named should engage with the Inheritance Enquiry Unit of my Department which will assist in bringing all outstanding matters to completion. That Unit can be contacted at:

An application under the Single Payment Scheme/Disadvantaged Areas Scheme was received from the person named on 21 April 2011, processing of which has recently been completed, thereby allowing the 50% advance payment under the Single Payment Scheme to issue on 28 October. Payment under the Disadvantaged Areas Scheme also issued to the applicant on 28 October and the balancing payments under the Single Payment Scheme will commence to issue on 1 December, as is provided for in the relevant EU Regulations.

Amharc ar fhreagraThe person named was approved for participation in the Agri-Environment Options Scheme with effect from 1 November 2010. Under the EU Regulations governing the Scheme and other area-based payment schemes, a comprehensive administrative check, including cross-checks with the Land Parcel Identification System, must be completed before any payment can issue. During these checks a query arose in relation to an error on the 2010 Single Payment Scheme application from the person named. This query has now been resolved and payment will issue shortly.

Amharc ar fhreagraAn application under the 2011 Single Payment Scheme was received from the person named on 16 May 2011, following processing of which over-claims were identified on two of the parcels declared by the person named. The person named has been written to in this regard and, on receipt of a satisfactory reply, the application will then be further processed with a view to the appropriate payment issuing shortly thereafter.
