Ceist:

107 Deputy Áine Collins asked the Minister for Social Protection the reason an appeal was originally refused in respect of a person (details supplied) in County Cork, in view of the recent European Court of Justice ruling which found that parents of Irish citizens are entitled to live and work in Ireland and consequently would be entitled to the same benefits as Irish citizens if unemployed. The Social Welfare Appeals Office has advised me that no appeal, by the person concerned, was received by that office. The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.
